Our Founding Fathers prepared the Bill of Rights so that Americans could maintain the rights they deserve without the government being able to take them away. One of the most important guaranteed rights we as citizens own is the right of due process.
If the Founding Fathers could see how these clear rights have been violated little by little over time, they would be shaken and horrified. These days, “speedy trials” are rare and “excessive bail” is normal. Every day we see our jails becoming more and more overwhelmed by citizens who suffer behind bars because they can’t afford bail in a system unable to provide them with a trial. This is not how the right of due process was intended.
A better way is possible, and we believe that starts with including the following in the due process rights:
- A system where non-violent defendants are allowed to await trial at home with their families while working in jobs unless they are determined to be a threat to others or unlikely to appear before the court.
- A system where in the rare case monetary bond is even used, it is determined by judging the means of the defendant, not the size of the newspaper headlines.
- A system where arraignments and trials happen more quickly because we’ve always known that justice delayed is justice denied.
